In short

In short

These Terms are the agreement between you and us about using Dawzr. The full text is below. Here is what it comes down to.

  • Dawzr is free. There is nothing to pay and nothing to cancel.

  • What you make stays yours. We ask for permission to show it to the people you chose, and nothing more. When you delete something, that permission ends with it.

  • You need to be 16. Dawzr holds the places that meant something to you and what they were like, and choosing who sees that takes some judgement. So does being someone other people can rely on.

  • Be worth trusting. Much of what you find here is somebody else's visit, which means somebody is finding their way through yours.

  • You can leave whenever you want, and deleting your account deletes your data immediately.

  • We tell you before we change things, and we want to hear what you think while it can still change. If a change leaves you worse off anyway, you can end this agreement at no cost.

If you think any of this could be clearer or fairer, we would welcome hearing it at support@dawzr.com.

General support

support@dawzr.com

"We", "us" and "our" mean Atane BV. "You" means you, the person using Dawzr.

support@dawzr.com is our point of contact for you, for anything covered by these Terms and for anything required under the Digital Services Act. A person reads it, and a person answers you.

  1. What these terms cover

These Terms apply to the Dawzr app for iOS and Android, the website at dawzr.com, share links, and the support we give by email. Together we call that "Dawzr" or "the service".

They form an agreement between us the moment you create an account, and they are the whole of that agreement together with:

  • our Privacy Policy, which explains what we do with your personal data and is part of these Terms by reference.

These Terms are for people using Dawzr for themselves. If you want to use Dawzr for a business, write to support@dawzr.com first, because that is a different arrangement and these Terms are not it.

These Terms are written in English. If any of it is unclear to you, write to support@dawzr.com and we will explain it in Dutch or French.

  1. What Dawzr is and what we promise about it

Dawzr is for discovering places, and the visits people had in them. You can search the map, type what you are after, filter by the vibe you want, and follow the people whose taste you trust. You save the places worth keeping, record the visits, say what they were like, write notes, add photos and video, pick the vibe a place had, build lists, and share any of it as narrowly or as widely as you want.

And on Dawzr you can inspire somebody to go there. Not a list of where you have been, but what it was like: the vibe you picked for a restaurant, a note about the evening you had in it, a photo of the room. That is what the next person reads, and it is what the sharing is for. A place you write about is somewhere somebody may actually go.

What we promise. We will provide Dawzr with reasonable care and skill. It will match what we describe on this page and in the app stores, it will be fit for the purpose you got it for, it will be of the quality you can reasonably expect from a service like this, and we will keep it updated so it stays that way. These are your legal rights under European consumer law and nothing in these Terms takes them away.

Availability. We do our best to keep Dawzr running without interruption. Maintenance, faults and network problems reach every service there is, so when something has to come down we schedule it for quiet hours where we can, and we tell you in advance about anything significant.

How long Dawzr runs. We are building Dawzr to last, and everything we promise above holds for as long as we offer it. If we ever have to close it down, you get told well in advance and a way to take your visits, notes, photos and lists with you first. Your memories should outlast us.

What other people write is theirs, and we do not check it. A note, a vibe, a photo or a reaction on Dawzr is somebody's account of somewhere, offered in good faith and worth what an account from a stranger is worth.

To be specific about what that means, because it is the question worth asking of any app that shows you what strangers thought. Today we take people at their word. There is no receipt, no check-in proof and no ticket behind a vibe or a note. What stands in its place: every vibe and note is attached to a real account rather than posted anonymously, section 5 asks people to be straight about where they have actually been, and section 6 forbids manipulating vibes or the feed and gets accounts closed for it.

And we are building ways to help you judge that. Signals that let you see whether a piece of content, or the person behind it, can reasonably be trusted. When one of them ships we will tell you exactly what it means, so it gets read for what it actually shows.

Beyond that, use your judgement, the same way you would with a recommendation from a friend or a friend of a friend.

  1. Who Dawzr is for

Dawzr is for people aged 16 and over. When you set up your profile you give us your date of birth, and by accepting these Terms you confirm you are old enough to be here.

We check the date you enter. We cannot check the person behind it, so this one rests on you. If we learn that an account belongs to someone under 16, we close it and delete what it holds.

We set sixteen for two reasons. Dawzr holds the places that meant something to you and what they were like, and deciding who gets to see that asks something of the person deciding. And Dawzr works because people rely on each other's taste, so being worth relying on asks something too. Sixteen is where we think it is fair to expect both.

Sixteen is our own floor rather than a legal minimum. The age at which someone can agree to a service like this on their own varies across Europe, and setting ours at 16 means the answer is the same wherever you live.

  1. Be worth trusting

Dawzr runs on trust. You can search the map or type what you are after and find a place directly. What you find on top of that is other people's visits, their actual experience of a place, reached through the people whose taste you trust. Which means somebody is finding their way through your visits.

A vibe, a tag, a note, a photo: each one is somebody's word, and the next person reads it as somebody's word and may go there on the strength of it. Honesty is the material this is built from.

So we ask for the plain version of it:

  • The date of birth you enter is your real one.

  • The name on your profile is a name people would know you by.

  • A place you say you visited is a place you visited.

  • A photo or video you post is yours to post.

  • A vibe you pick is what you actually felt there.

Nobody gets this perfect, and honest is the bar. When something you wrote turns out to be wrong, change it. Everything you put on Dawzr stays yours to edit or delete, and correcting something later is part of using it well.

  1. How we treat each other

The short version is good manners. Toward other people, and toward yourself.

Toward yourself. A collection of places adds up to more than the places in it, which is a more personal thing than it first feels. Before you make something public, it is worth a second of thought: your home, your routine, the hours you keep, the places you go alone. A memory that is lovely to keep can be more than you want to hand to strangers. Choosing "friends" is simply choosing well, and you can change your mind on any item at any time.

Toward the people in your photos. Somebody who happens to be at the table did not necessarily choose to be on the internet. Ask them, or crop them out, or keep it private. It costs nothing and it is the difference between a memory and an exposure.

Toward everyone else. Write about places the way you would talk about them to someone you respect. Be generous about the small place doing its best. Be honest when somewhere let you down, and be fair about why. Disagree with someone's vibe by adding yours rather than by going after them.

Some things have no place on Dawzr, and we will remove them and close the accounts behind them:

  • harassment, threats, and abuse

  • hatred aimed at people for who they are

  • sexual content involving children

  • impersonating somebody else

  • posting another person's private information

  • content that belongs to someone who did not agree to your posting it

  • deliberate manipulation of vibes, ratings or the feed, whether by hand or by machine

  • anything that is against the law where you are or where we are

  1. Your Account

Your account is yours and it is one person. Keep your password to yourself, and use a different one here than you use elsewhere. If you think somebody else has got into your account, change your password immediately and tell us at support@dawzr.com.

You are responsible for what happens on your account. If you lend it to someone, what they do is yours.

If we have closed an account of yours for breaking these Terms, please do not open another one. If you think we got that decision wrong, section 12 is the way to take it up with us.

Your profile has a visibility setting, and every visit, note, photo, video, saved place and list carries its own. You choose those, you can change them at any time, and the Privacy Policy explains exactly what each one means.

About share links. A share link is an unguessable web address that opens one specific thing. Two conditions have to hold for the person who opens it to see anything: the content is still there, and your settings allow that person to see it. Anyone you send a link to can pass it on, so treat it the way you would treat a link to an unlisted video. You can see how many distinct people opened it.

  1. Your content and the permission you give us

What you make is yours. Every visit you record, note you write, photo and video you upload, vibe you pick and list you build belongs to you. Putting it on Dawzr changes nothing about who owns it.

A place belongs to nobody. A restaurant, a beach, a bar is out there in the world and it is everybody's. What is yours is the visit you had there and what you said about it. Saving a place adds it to your collection; it takes nothing away from anyone else, and it grants you nothing over the place itself.

What we need in order to show it. To run Dawzr we need your permission to hold your content on our servers and put it in front of the people you chose. So you give us a licence that is non-exclusive, worldwide and free of charge, to store, copy, adapt for display, and deliver your content through Dawzr, strictly for the purpose of operating the service for you and for the people you shared it with. Adapting for display means the ordinary technical work: making a thumbnail, resizing a photo for a phone, transcoding a video so it plays.

That is the whole of it. We do not take the right to pass your content to anyone else, to sell it, to put it in an advertisement, or to use it in our own marketing. If we ever want to feature something you made, we will ask you first, and you are free to say no.

It ends when you end it. Delete a photo and the licence over that photo ends. Delete your account and it ends over everything. Copies may sit in our backups for a short period, described in the Privacy Policy, and they are not shared with anyone. Somebody who already took a copy of something you shared with them still has it, which is true of everything on the internet and worth remembering when you choose a setting.

What other people get. When you share something with someone, they get permission to view it inside Dawzr, and nothing further. When you add a place to a list you build with other people, they get to see that place on that list.

One thing that outlives your account, and only one. If you added a place to a list that somebody else owns, and that list survives because they are still there, the place stays on the list with your name taken off it. Everything else you made, your visits, notes, photos and videos, is deleted wherever it appeared.

What you are telling us when you post. That it is yours to post, that you have the rights to it, and that showing it on Dawzr breaks nobody's copyright, trademark or privacy. If somebody comes to us with a claim about something you posted, that is between you and them, and we will pass on what we have to.

  1. What Dawzr contains besides your content

Our part. The app, the website, the design, the name, the logo, the vibe system and the code behind all of it are ours. You get permission to use Dawzr as it is meant to be used, on your own devices, for yourself. That permission does not extend to copying it, reselling it, or building something out of it.

Places and maps. Place details, maps, addresses and some photos come from outside providers named in the Privacy Policy. Their terms apply to their data, and we pass it to you as we receive it.

Links out. Dawzr links to venues' own sites and to other services. We do not control those and we are not responsible for what is on them.

  1. What you may not do

Beyond section 6, which is about how you treat people, these are about the service itself. Do not:

  • scrape, crawl, harvest or copy Dawzr's content in bulk, by hand or by machine

  • use bots or automation to create accounts, post content, or interact with other people

  • reverse engineer, decompile or take Dawzr apart, except where the law says you may

  • get around our access controls, rate limits or security measures

  • put unreasonable load on our systems, or interfere with anyone else's use of them

  • use Dawzr commercially without asking us, including reselling access or advertising through it

  • upload anything designed to damage a system or take data from one

If you want to build something on Dawzr, write to support@dawzr.com and tell us what you have in mind. We are open to it.

  1. Telling us when something is wrong

If you come across something that should not be here, write to support@dawzr.com and tell us what it is and where you found it. We read every one of these. An in-app way to report a specific item is on the way; until it ships, email is the route.

Tell us what you saw, where it was, and why you think it does not belong. That is enough. You do not need to write it formally.

We ask one thing in return: report things you genuinely think are wrong. A person reads every one of these, so treat them with respect.

You can also block an account at any time, from anywhere you see it. A block works both ways: they lose access to your content, and theirs stops reaching you, across feeds, lists and suggestions alike. Blocking applies to an account rather than to a single item.

  1. How we moderate and how you contest it

What we do. We look at content when somebody reports it, when an automated check flags something, and when we come across it ourselves. We look where we are pointed rather than reading everything, and the law leaves that choice to us.

How we decide. Against section 6 and against the law. We take the context into account, and we try to act in proportion: a first mistake and a pattern of harm are different things.

What automation does. We use automated checks to spot a small number of clear cases, such as content matching known illegal material and obvious spam. No account is closed by a machine. A person reviews anything beyond content removal before it happens.

What we can do. Depending on what we find, in roughly this order: leave it alone; get in touch and ask you to change it; remove or hide the content; limit a feature on your account; suspend the account; close it. We reach for the mildest thing that solves the problem.

What we owe you when we act. If we remove your content, limit your account or suspend it, we will tell you at the email address on your account and we will say: what we did, what rule it was under, what we relied on, whether automation was involved, and how to contest it.

And we tell you before we close an account, where we can, so you have time to ask for a copy of what you made. Write to privacy@dawzr.com and we will send it to you. The exception is the same one as in section 14: where waiting would cause real harm, we act first.

How you contest it. Reply to that email, or write to support@dawzr.com. A person will look at it again, and we will tell you the outcome. If we got it wrong we put it back, and we will say so.

What stays up. An honest bad review, an unpopular opinion about a place, a vibe only you picked. We leave those alone, including when we disagree with them.

  1. What Dawzr costs

Dawzr is free. There is no subscription, no premium tier, and no way to pay us from inside the app. Everything Dawzr does today, it does for free.

We may charge for something later, and if we do, three things hold.

  • Paying stays your choice, with its own terms and the price shown to you before you agree to anything.

  • We tell you in advance, by email or in the app.

  • Section 16 applies. If a change to Dawzr makes things materially worse for you, and putting something you rely on behind a price would, you can leave free of charge within thirty days of us telling you, or of the change taking effect, whichever is later.

Downloading Dawzr may cost you data charges from your mobile operator. That is between you and them.

  1. Ending it

Your side. You can stop using Dawzr whenever you like, with no notice and no reason. To delete your account, go to Settings in the app, or to dawzr.com/support/account/delete.

What deleting actually does. It runs immediately. Your places, visits, lists, notes, reactions, social connections, share records, uploaded photos and video, and your account itself are removed in one operation. The delete is real and it is final, which also means we cannot undo it for you afterwards. The Privacy Policy sets out the detail.

Your fourteen-day right of withdrawal. European law gives you fourteen days from creating your account to withdraw from this agreement without giving a reason. Since Dawzr is free, withdrawing costs you nothing and there is nothing to refund.

Deleting your account is how you withdraw. Settings in the app, or the link above. That is the whole procedure. It runs immediately, it needs no form, no reason and no waiting for us, and it does everything withdrawing does. The right runs for fourteen days; the delete button stays there for as long as you want it.

If you would rather put it in writing, an email to support@dawzr.com saying you withdraw is enough, and the standard European form below works too. Neither is faster than the button.

To Atane BV, Meiweg 8, 9870 Zulte, Belgium, support@dawzr.com:
I hereby give notice that I withdraw from my contract for the use of Dawzr.
Name: [your name] · Account email: [your email]
Account created on: [date] · Date: [today]

Taking your things with you. Before you delete, you can ask us for a copy of what you made. Write to privacy@dawzr.com and we will send it to you. We are building a way to do this yourself from the app; until it lands, asking us is the route, and you get the same thing.

Our side. We can restrict, suspend or close an account where you have seriously or repeatedly broken these Terms, where the law requires it, or where keeping it open would put other people or the service at risk.

We will give you notice and a chance to respond first. The exception is where waiting would cause real harm, which means content that is clearly illegal, an active threat to someone, or an attack on the service. In those cases we act first and tell you straight after.

Either way you get the message described in section 12, and you can contest it.

What survives. Sections 8 (as to content that stays on a shared list), 15, 16 and 17 keep working after your account ends.

  1. Our responsibility and its limits

What we are responsible for. Loss you suffer because we broke these Terms or failed to use reasonable care and skill, where that loss was a foreseeable result.

What we are not responsible for. Loss nobody could have foreseen. What other people post. What is on a site we linked to. Anything outside our reasonable control. And business losses: Dawzr is for personal use, so lost profit, revenue or opportunity are not ours to carry.

What the law does not let us limit, we do not. Death or personal injury caused by our negligence, fraud, gross negligence, and intentional wrongdoing. Your rights as a consumer, including the guarantee that Dawzr matches what we described, stay whole.

If Dawzr fails you. You have the remedies European law gives you: we bring the service back into conformity, and where that fails or takes too long you can end the agreement. Since Dawzr is free, there is no price to reduce or refund.

Your side of it. If something you post causes a claim against us, we may ask you to cover what it costs us, to the extent it was your doing.

  1. Changes to these terms and to Dawzr

We can change these Terms, and only for a reason, and only in one of these cases:

  • the law changed, or a regulator or a court told us to

  • Dawzr changed, and the Terms need to describe what it now does

  • we added something, or retired something

  • security or safety needs it

  • something in here turned out to be unclear or wrong

How we tell you. By email or in the app, at least thirty days before a change takes effect, saying what changed. Where a change leaves you worse off, by email, so you have it in writing. Every release of Dawzr also carries release notes describing what is in it, published on the day the release goes out. Between them there is always a dated record of when you were told, and that is what the thirty days below run from.

Those thirty days are there so we can hear from you. Write to support@dawzr.com and tell us what the change does to the way you use Dawzr. We would rather adjust something than lose you over it, and a change we announced is still a change we can revise.

If you would rather not continue on the new version, delete your account before it takes effect, and the version you agreed to is the one that applied for as long as you were here. Carrying on using Dawzr after the date means you accept the new one. Changes never apply backwards.

Where a change is purely a correction or purely in your favour, we may make it sooner and tell you when we do.

Every version of these Terms is dated, and we keep the earlier ones. If you want to see the text that applied when you joined, or on any date since, ask at support@dawzr.com and we will send it.

We can also change Dawzr itself, and the same discipline applies. For anything beyond keeping the service working as described, we will have a reason of the kind listed above, it will cost you nothing, and we will tell you in advance. Here too, tell us if you think we have got it wrong, because that is the point of telling you first.

And if a change makes Dawzr materially worse for you, you can end this agreement free of charge within thirty days of us telling you, or of the change taking effect, whichever is later, by writing to support@dawzr.com or deleting your account.

  1. If something goes wrong between us

Start with us, and give us a chance to put it right. Write to support@dawzr.com and tell us what went wrong. We answer within five working days, and we will work with you for up to sixty days to settle it between us before either of us takes it further. Most disputes could have stayed a conversation, and almost all of them are cheaper and quicker to fix that way for both of us.

Mediation. If we cannot sort it out between us, you can take it to the Belgian Consumer Mediation Service, a federal body that handles consumer disputes with Belgian traders free of charge. It is the one dispute-resolution body we point you to, and it is open to you whatever we join or do not join:

Consumentenombudsdienst / Service de médiation pour le consommateur
Koning Albert II-laan 8 bus 1, 1000 Brussel, Belgium
contact@consumentenombudsdienst.be · consumerombudsman.be

Law and courts. These Terms are governed by Belgian law, and Atane BV is established in Belgium, so the Belgian courts are always open for a dispute between us.

If you live in another EU country, two things also hold, and European law puts them there rather than us. You keep the protection of the consumer law of the country you live in. And you can bring a case either in Belgium or where you live, while we would have to bring one where you live.

  1. Other things

These Terms are between you and us. You cannot transfer them to somebody else. We can transfer them if Dawzr is sold or reorganised, and we will tell you before that happens, and it will not reduce your rights. If it does, delete your account and nothing more is owed either way.

If one clause fails, the rest stands. A clause held to be unenforceable is removed and the remainder keeps working.

A right we delay using, we keep. If we let something pass at the time, we can still act on it later.

Usernames. We may reclaim a username that impersonates somebody, infringes a trademark, or belongs to an account we closed.

About the app stores. You get Dawzr from Apple or Google, and this agreement is between you and us rather than with them. They are not responsible for Dawzr, for its content, or for supporting it. If Dawzr does not work as it should, tell us at support@dawzr.com. Apple and its subsidiaries may enforce the parts of this agreement that concern them.
